Do you know the difference between a Environmental Impact Declaration (EID) of an Environmental Impact Study (EIS)?

In the context of the new… Ley SBAP (Servicio de Biodiversidad y Áreas Protegidas), which seeks to strengthen biodiversity protection and improve environmental management in Chile, understanding these tools is key for the sustainable development of projects in the country.

The The EID …is submitted when a project does not generate significant impacts on the environment, which means its processing before the Environmental Evaluation Service (SEA) is more limited. In contrast, the… EIS …is required when there are potential significant impacts on communities, ecosystems, or protected areas, incorporating more rigorous mitigation, compensation, and monitoring measures.

With the entry into force of the SBAP Law, both instruments will be required to more precisely incorporate… biodiversity, conservation, and ecological connectivity criteria, marking a paradigm shift in environmental assessment in Chile. This new institutional framework elevates biodiversity conservation to a central role in project development, making environmental management more technical, transparent, and responsible.

SBAP Law Criteria in Environmental Assessment

The SBAP Law introduces new standards in project evaluation, placing the focus on the biodiversity, ecological connectivity, and the protection of sensitive areas.

Among the main changes are:

  • Greater technical rigor: More complete baseline studies and ecological assessments will be required to identify relevant species and habitats.
  • Ecological connectivity: Projects must analyze their effect on biological corridors and propose measures to prevent habitat fragmentation.
  • Expanded protection: Projects located near protected areas or priority sites must demonstrate that they will not affect conservation targets.

Challenges for Investment and Industry

While the SBAP Law represents a step forward in environmental matters, its implementation presents significant challenges for investment and industry.

The increase in technical requirements and the depth of the studies may lead to longer timelines and higher costs in environmental permitting, especially for medium-sized projects or those in early stages. In addition, the lack of uniform criteria among institutions could result in regulatory uncertainty and a bigger greater administrative burden.
