In contrast, the… EIS …is required when there are potential significant impacts on communities, ecosystems, or protected areas, incorporating more rigorous mitigation, compensation, and monitoring measures.
With the entry into force of the SBAP Law, both instruments will be required to more precisely incorporate… biodiversity, conservation, and ecological connectivity criteria, marking a paradigm shift in environmental assessment in Chile. SBAP Law Criteria in Environmental Assessment

- Expanded protection: Projects located near protected areas or priority sites must demonstrate that they will not affect conservation targets.
Challenges for Investment and Industry
While the SBAP Law represents a step forward in environmental matters, its implementation presents significant challenges for investment and industry.
The increase in technical requirements and the depth of the studies may lead to longer timelines and higher costs in environmental permitting, especially for medium-sized projects or those in early stages.
